Terms of Service

Last updated: October 30, 2026

These Terms of Service ("Terms") govern the services provided by VOLLP LLC, a New Mexico limited liability company with its registered address at 412 W 7th St, STE 779, Clovis, NM 88101, United States ("VOLLP", "we", "us"), to its business clients ("Client"). By engaging VOLLP or using this website, you agree to these Terms.

1. Services

VOLLP provides business-to-business creative services, including creative strategy, research, ad scripts, storyboards, editor briefs, ad copy and video editing. The scope, deliverables, schedule and fees of each engagement are defined in a written proposal, statement of work or email agreement ("Agreement"). If an Agreement conflicts with these Terms, the Agreement prevails.

2. Fees and payment

Fees, payment schedule and any other commercial terms are set out in each proposal or agreement. Work may be paused while an overdue balance is outstanding.

3. Client responsibilities

The Client provides timely access to the information, product details, brand assets and feedback needed to perform the services, and confirms that it has the rights to any materials it supplies. The Client is responsible for the final approval of ads before publication and for compliance of its own advertising with platform policies and applicable law.

4. Intellectual property

Upon full payment, the Client owns the final deliverables created specifically for it. VOLLP keeps ownership of its general methods, templates, know-how and pre-existing materials, and may use non-confidential, anonymized descriptions of its work to describe its services.

5. Confidentiality

Each party keeps confidential any non-public information received from the other party, including performance data, strategies and unreleased materials, and uses it only to perform the Agreement.

6. No guarantee of results

Advertising results depend on many factors outside VOLLP's control, including media buying, budget, product, pricing and platform algorithms. VOLLP does not guarantee specific sales, returns or advertising performance.

7. Limitation of liability

To the maximum extent permitted by law, VOLLP's total liability under any engagement is limited to the fees paid by the Client for that engagement in the three months before the claim. VOLLP is not liable for indirect, incidental or consequential damages, including lost profits.

8. Termination

Either party may end an ongoing engagement with 14 days' written notice, unless the Agreement states otherwise. The Client pays for work performed up to the termination date.

9. Governing law

These Terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict of laws rules.
